COMPANY PROFILE
Medco Health Solutions Inc. is the leading phar-
macy benefits manager in the United States. Medco
integrates 60,000 retail pharmacies with its mail-order
pharmacy operations, the world’s largest. It features
cardiovascular, diabetes and chronic illness manage-
ment, home health care products including biotech
injectables, and Medicare support for its customers.
In addition, Medco handles drug benefits for unions,
corporations, health maintenance organizations,
insurance companies and federal employees. It has
approximately 22,000 employees, including 2,200
pharmacists. Its services cover more than 60 million
Americans. Medco is ranked No. 35 on the Fortune
500 list of the country’s biggest companies, with more
than $51 billion in revenues in 2008. It is based in
Franklin Lakes, N.J.
LEGAL TEAM AND OUTSIDE COUNSEL
Medco’s legal department is a group of 123, of
whom 36 are attorneys. The squad is responsible for
a broad range of matters, including the legislative and
policy areas. Medco’s is an active in-house practice,
and Moriarty tries to handle the bulk of the company’s
transactions and litigation internally. However, major
mergers and alliance-related work go outside, as does
some litigation management. Moriarty retains local
counsel for matters in foreign locales, and Medco takes
pains to comply with the Foreign Corrupt Practices Act
of 1977. The company works with a trio of Washington-based firms: Howrey (corporate matters); Williams &
Connolly (litigation); and Crowell & Moring (government
programs). Four other occasional partners are New

DAILY DUTIES
In moving up the corporate ladder Moriarty has
become more specialized, “but at the same time [I
need] a broader spectrum and view.” Extensive interaction with Medco’s senior team is typical of Moriarty’s
workday. His department is deeply involved in health
care reform, on both the state and federal levels.
Medco does what it can to influence public policies
affecting costs and patient outcomes. Reviewing litigation, mergers and acquisitions or other transactions
is part of his regular routine. Moriarty makes sure
to spend time with staff members to make sure he
knows what’s going on and to fulfill his professional
obligations as the department’s leader.
